Obchodní podmínky

1. Definice

"Service" means the FanSpeak application available at fanspeak.io and related services. "User" means any individual or entity that creates an account. "Connected Platform" means any third-party service (e.g. YouTube, Instagram) linked to your FanSpeak account via OAuth2.

2. Způsobilost

You must be at least 16 years old to use FanSpeak. By using the Service, you represent that you meet this requirement and that you have the authority to bind yourself (or the entity you represent) to these Terms.

3. Account Registration

You may register using your Google account or your email address. You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account. You must notify us immediately of any unauthorized use.

4. Popis služby a data externích platforem

FanSpeak connects to third-party platforms (YouTube, TikTok, Instagram, WordPress and others) via OAuth2 or other authorized APIs to retrieve and display comments, reactions and other user-generated content from those platforms.

• Access to external platform data is granted by you through the platform's own authorization flow. FanSpeak acts as an authorized agent on your behalf.
• FanSpeak stores a copy of retrieved comments and related metadata in its own database to enable the features of the Service (inbox, search, reply tracking, analytics).
• You are responsible for ensuring that your use of FanSpeak complies with the Terms of Service of each connected platform.
• FanSpeak will only post to a platform when you explicitly trigger a reply or response action.
• You may revoke FanSpeak's access to any connected platform at any time, either from within FanSpeak or directly from the platform's own security settings.

5. Přijatelné použití

Souhlasíte, že nebudete službu používat k:

• Porušení jakéhokoli platného zákona nebo předpisu
• Šíření spamu, obtěžování, nenávistných projevů nebo urážlivého obsahu
• Pokusu o neoprávněný přístup k jiným účtům nebo systémům
• Resell, sublicense or otherwise commercialize access to the Service without our written consent
• Zpětnému inženýrství nebo scrapování platformy FanSpeak

6. Duševní vlastnictví

FanSpeak and its original content, features and functionality are owned by the operator and are protected by copyright and other intellectual property laws. Comments and content retrieved from external platforms remain the property of their respective owners and platforms.

7. Disclaimers

The Service is provided "as is" without warranties of any kind. We do not guarantee uninterrupted availability or that the Service will be error-free. We are not responsible for actions taken by third-party platforms that affect your connected accounts.

8. Omezení odpovědnosti

To the maximum extent permitted by law, FanSpeak shall not be liable for indirect, incidental, special, consequential or punitive damages arising out of your use of the Service, even if we have been advised of the possibility of such damages.

9. Ukončení

You may close your account at any time from the account settings page. Upon termination, your data will be deleted within 30 days, except where retention is required by law. We may suspend or terminate accounts that violate these Terms.

10. Rozhodné právo

These Terms are governed by the laws of the Czech Republic, without regard to conflict of law provisions. Any disputes shall be resolved in the courts of the Czech Republic.

11. Změny podmínek

We may update these Terms from time to time. We will notify registered users by email at least 14 days before significant changes take effect. Continued use of the Service after that date constitutes acceptance of the updated Terms.
